The fundamental human right of peaceful assembly, freedom of speech and freedom of association are enshrined in the First Amendment of the United States Constitution. However, the reality is that attending rallies or demonstrations to exercise these rights carries inherent physical risk – and this is particularly the case where the reason for gathering is one where there are strongly held passions associated with perceived injustice, polarizing or divisive viewpoints, or is otherwise socially or politically contentious. Rallies and demonstrations, by their nature, carry inherent risk.
